This page defines the operating parameters for a TFP session: what it is, what both parties receive, and how the resulting material may be used. Use the anchors below to jump to your preferred language block.
Ein TFP-Photoshooting steht für „Time for Pictures“ oder „Time for Prints“. Es ist eine Vereinbarung zwischen Fotograf und Model, bei der beide Parteien Zeit und Fähigkeiten investieren – ohne finanzielle Vergütung. Stattdessen erhalten beide Parteien das Recht, die entstandenen Fotos für ihre eigenen Zwecke zu nutzen.
§ 1 Vertragsgegenstand
- Das Model stellt sich dem Fotografen WieErWill am vorab vereinbarten Ort und Zeit für Fotos zur Verfügung.
- Die Art der Fotos wird je nach Absprache und Gelegenheit vorab festgelegt.
- In der Regel dauert ein Shooting zwischen 30 Minuten und 2 Stunden.
§ 2 Vertragszweck
- Eigenwerbung: Die Fotos werden zum Zwecke der Eigendarstellung der Parteien in künstlerischer Art angefertigt, insbesondere zur Selbstvermarktung (private Zwecke), jedoch nicht für eine geldwerte Verwertung. Eine geldwerte Verwertung ist nur mit Genehmigung der anderen Partei gestattet und steht unter der Bedingung, dass diese am Nettogewinn entsprechend beteiligt wird, mindestens 25%. Konditionen der entgeltlichen Verwertung sind offenzulegen.
- Nutzungsrechte uneingeschränkt: Zeitlich, örtlich und sachlich uneingeschränkt, sofern nicht abweichend in Textform vereinbart.
- Nutzung durch Dritte: Grundsätzlich ausgeschlossen. Visagist(in) erhält Nutzungsrecht gemäß §2.1/§2.2. Model darf Fotos an Agentur(en) weitergeben und für Sedcards nutzen; Agenturen dürfen ohne schriftliches Einverständnis des Fotografen die Fotos nicht für eigene Werbung nutzen.
§ 3 Rechte und Pflichten des Models
- Begleitperson: Eine Vertrauensperson ist erlaubt, darf das Shooting nicht stören.
- Gegenleistung: Keine Vergütung. Innerhalb von 2–4 Wochen erhält das Model mindestens 3 und maximal 10 bearbeitete Fotos via Download-Link in Print-Auflösung.
- Bearbeitungsverbot: Keine Manipulation/Retusche/Verfremdung, ausgenommen einfache Filter sozialer Netzwerke.
- Namensnennungspflicht: Bei Veröffentlichung soll „WieErWill“ genannt und Social-Media/Website verlinkt werden.
§ 4 Rechte des Fotografen
- Urheberrecht: Fotograf ist alleiniger Urheber. Negative/Bilddateien bleiben sein Eigentum; kein Herausgabeanspruch.
- Bearbeitungsrecht: Bearbeitung und leichte Retusche erlaubt. Starke Bearbeitungen nur mit schriftlichem Einverständnis beider Seiten.
- Verwertungsrecht: Nutzung für Wettbewerbe, Ausstellungen (§18 UrhG) und Druckmedien nur nach schriftlichem Einverständnis der anderen Partei. Bei entgeltlicher Nutzung: mindestens 25% Beteiligung des Fotografen.
- Namensnennungspflicht: Fotograf soll bei Veröffentlichung den Namen des Models verwenden und ggf. Social-Media verlinken.
§ 5 Haftung
- Ausschluss für Schäden: Keine Haftung bei fahrlässiger Pflichtverletzung, außer bei Leben/Körper/Gesundheit. Sonstige Schäden bei grober Fahrlässigkeit oder Verletzung wesentlicher Pflichten – beschränkt auf vorhersehbare Schäden.
- Haftung des Models: Für grobe Beschädigungen der Ausrüstung haftet das Model bei Verschulden.
§ 6 Absage des Shootings
- Bis eine Woche vorher: kostenfrei.
- Unter 48 Stunden: 50 Euro Gebühr.
§ 7 Widerruf der Einwilligung
Widerruf glaubhaft begründet und schriftlich. Nur aus wichtigem Grund, nicht willkürlich. Wichtige Gründe sind z. B. gravierende Änderungen persönlicher oder beruflicher Umstände.
§ 8 Gerichtsstand/Rechtswahl
- Erfüllungsort und Gerichtsstand: Wohnsitz des Fotografen.
- Deutsches Recht unter Ausschluss kollisionsrechtlicher Verweisungen.
§ 9 Formerfordernis
Nebenabreden und Änderungen bedürfen Schriftform; E-Mail genügt. Gilt auch für die Abbedingung dieses Schriftformerfordernisses.
§ 10 Salvatorische Klausel
Unwirksamkeit einzelner Regelungen berührt den Rest nicht. Anstelle gilt eine Bestimmung als vereinbart, die dem Zweck bestmöglich entspricht.
A TFP photo shoot stands for “Time for Pictures” or “Time for Prints”. It is an agreement between a photographer and a model where both parties invest their time and skills without financial compensation. Instead, both parties receive usage rights to the resulting photos for their own purposes.
§ 1 Subject Matter of the Contract
- The model provides the photographer WieErWill with availability for photos at the agreed place and time.
- The type of photos will be determined in advance depending on agreement and opportunity.
- Typically, a photo shoot lasts between 30 minutes and 2 hours.
§ 2 Purpose of the Contract
- Self-Promotion: The photos are taken for artistic self-promotion (private purposes), not for monetary exploitation. Monetary exploitation requires consent of the other party and at least 25% net profit participation. Paid usage conditions must be disclosed.
- Usage Rights Unrestricted: Unlimited in time, place, and scope unless otherwise agreed in writing.
- Third-Party Use: Generally excluded. If a makeup artist is involved, they receive usage rights under §2.1/§2.2. The model may share photos with agencies for sedcards; agencies may not use photos for their own advertising without the photographer’s written consent.
§ 3 Rights and Obligations of the Model
- Companion: The model may bring a trusted person, who must not disturb the shoot.
- Compensation: No remuneration. Within 2–4 weeks, the model receives at least 3 and at most 10 edited photos via download link in print resolution.
- Editing Prohibition: No manipulation/retouching/alteration except simple social media filters.
- Credit Requirement: When publishing, the model should credit “WieErWill” and link the relevant channels.
§ 4 Rights of the Photographer
- Copyright: The photographer is the sole author. All negatives/image files remain his property; no claim by the model.
- Editing Rights: Minor edits/retouching allowed. Major edits require written consent of both parties.
- Exploitation Rights: Usage for contests, exhibitions (§18 UrhG), and print media only with written consent of the other party. Paid usage: at least 25% revenue share for the photographer.
- Credit Requirement: When publishing, the photographer should credit the model and link the model’s channel if available.
§ 5 Liability
- Exclusion of Damages: No liability for negligent breach of duty, except injury to life/body/health. Liability for other damages due to gross negligence or breach of essential obligations is limited to foreseeable damages.
- Liability of the Model: The model is liable for gross damage to camera/equipment if at fault.
§ 6 Cancellation of the Shoot
- Cancelling up to one week in advance is free of charge.
- Cancellations within 48 hours incur a fee of 50 euros.
§ 7 Revocation of Consent
Revocation must be credibly justified and in writing. Both parties undertake to revoke only for important reasons, not arbitrary motives (e.g., significant changes in personal or professional circumstances).
§ 8 Jurisdiction / Choice of Law
- Place of performance and jurisdiction is the photographer’s residence.
- The contract is governed by German law, excluding conflict of laws rules.
§ 9 Formal Requirement for Amendments
Side agreements and amendments must be in writing; email is sufficient. This also applies to waiving this requirement.
§ 10 Severability Clause
If any provision is invalid or unenforceable, the remainder remains effective. A replacement provision applies that best achieves the intent and purpose of the contract.
